Would a 16th edition board class as a fail on a perioic,all socket circuits on rcd side and
all lights on non rcd side,as the customer does not want a new board installing.

NO. If it was compliant when it was fitted then it is OK now, the wiring regs are not retrospective. So you need to make no comments if all tests and insp's are OK
 
Non RCD protection of cables in walls less than 50mm etc would only warrant a code 4 on a PIR. When it was installed it complied with the regs (16th), now it just doesn't comply with the 17th doesn't mean it's dangerous, hence a code 4.
 
Yep I'm going code four. Also, if there is no RCD on lighting, is there sufficient supplimentary bonding in bathroom etc?
