Doesn't seem to go against any requirements of section 701 on the face of it. BS number compliant ?
I would say there could be issues with external influences due to splashed water but not a C2.
 
Well BS3052 is long gone, but was ok at some point. I believe this unit was intended to be installed with an earth to the tx but many were not, which makes them double trouble.
