Technically you can use ‘reasonable force’ under common law to detain individuals suspected of a crime that has either endangered life or to protect property. Store detectives can use the same law to detain shop lifters.

It’s always the same people circulating through prison, repeat offenders and no where to imprison them which leads to suspended and pending sentences. Our judicial system is a joke.
 
Don't know how these defence lawyers sleep at night when you see the type of people that end up getting away with stuff time after time.
 
With a little bit of knowledge; often these deaths result from an event called 'positional asphyxiation', where someone is detained or positioned for whatever reason face down, and held in that position. Sometimes its because the person is overweight, or because a healthy person is forcibly restrained, perhaps such as in this case. It prevents the lungs & diaphragm working normally.

Often the detained person, is fighting to breath, and often mistakenly by his captors as movements trying to free themselves. Police officers have done similar, without realising. Of course it might no be the reason in this case.

Something to consider if you do find yourself restraining some one, or offering first aid.

In this instance, revenge is never the best option however sweet it may seem temporarily. Years down the line the people involved will have to live with the outcome.

In this instance maybe not but I knew a few people who relished in the fact that they got their own back.

It is a sad out come that someone has died, I don't think any one could disagree with that statement. even if he was a tool thief it is a little disproportionate.

we do have a great legal system which is not perfect by any means or properly enforced at times but if you look around the world, I don't think there are any country's with a better system than us.

Innocent until proven guilty in a court of Law, judged by a court of your Peers.

I do hope the Two men who detained him do not have there lives ruined by this.

As a side note. the Last Van I had broken into, I Lost 5K worth of tools and testers, during the blood day while I was at a Job.....
The insurance company was a nightmare and didn't want to pay out( of course), I was so Lucky I have a good credit history and ability to buy my tools the next day, the insurance company did pay out 8 months Later ( after a fight), but it could of ruined me. my wife works and I was lucky I could barrow and scrape by to pay the bill and keep a roof over our heads.

I don't think these tool thief scum bag think there a victim here, there is, I could of so easily have lost my house if i could not of replaced my tools, it would of put my family in real hardship.
 
That’s what makes a criminal a criminal. Selfish acts based on greed or desperation with no regard for other people’s equipment, possessions or lifestyle.

But criminals are not always bad people beyond change. I personally know a few ex convicts who have full regret for their previous lifestyle and I’d consider them to be thoughtful, helpful and selfless people

The problem is is that there is no deterrent, we have prisons overflowing that government after government are been more lenient on prison terms if they ever get one nowadays. What we need is to put these scum delinquents into labour camps where they work hard to pay back society and they come out never wanting to return, when you got TV, games consoles, hot regular food, a bed then it don't take Einstein to work out why jail is no longer a deterrent.
Bring back national service to straighten them out or labour camps, then see how many re-offend.
 
Hateful that you have to save your money to but good quality tools to make your life easier only for someone like this to steal it and either use it or sell it. It's shocking and although this sounds terrible too they won't be missed

They may be a parent, a brother/sister, a daughter/son.

Stupid to say to they won’t be missed because chances are someone loves them

I’ve seen the inpact of drink driver’s on families. Many will forgive the person in court and move on which takes incredible spirit. Others not so. We’re human beings and all different I guess.
That into perspective, to wish ill of someone who has lost a life over replaceable belongings is a little silly.

Tradesmen (and women) tend to get angry as the stolen tools are their way to make money and keep their families warm, dry and fed. A lot of sole traders have gone under due to tool theft and this has had a massive impact on their families.

Tool theft is a very emotional subject, if I caught a thief in the act it would take a lot of restraint and self control not to break several bones in their body.

There is no defence for theft.

Something for another debate but; not had the odd biro or pack of envelopes from work, done an odd private job for cash, or even Mars bar from the local newsagent.

I have one memory of my late father in law, when visiting a local garden centre. He came out to my car, with a lovely tree sapling. We were struggling to fit it in the back of the car, wives were sat in the back waiting for us to leave, I said perhaps we'll ask them to deliver, he said F off I've just nicked it :eek:
 
The problem is that people who commit crimes do so without any real idea of what, if any, consequences there might be. This could be resolved over night if there was the political will.
What is required is a system of standard minimum tariffs for particular crimes. For example breaking into a vehicle and theft of contents could attract a MINIMUM sentence of 5 years. That way anyone choosing to commit that offence does so fully aware of the consequences.
The problem of repeat offenders is also easily managed. First offence, standard tariff, second offence, twice the standard tariff, third offence, 3 times the standard tariff and so on.
But there wouldn't be the prison capacity to cope I hear you cry. Again, easily solved. Lots of things get farmed out to India because it's cheaper. So could prisons. A contract to run a good quality prison service in India would no doubt save a fortune and increase capacity way beyond the present.
So your already once convicted van thief breaks into your van fully aware that if caught he's going to be spending the next 10 years in India. Up to him if he wants to take that chance.
 
Wouldn’t being in prison for GBH be a more loss of an earning than your tools? Which are replaceable, that we all have insurances for? Maybe I’m not grasping it as I’m employed!

And I’m not condoning tool theft by the way! There’s just better ways of dealing with it!
