I’m trying to figure out if I find direct line to be shirking there responsibilities, or the builder for not declaring his ccjs.

obviously it’s the builders fault, but who picks up the bill?

what more could the homeowner have done? Nothing. He got a builder with insurance.

Presumably the Builder has no assets as the claim is against the builder, who if covered by Insurance would use that, but if not, as a sole trader is personally responsible and would have to liquidate any assets and become liable for the remaining debt,, for every.

In the future, if it doesn't already exist, there's going to have be Insurance to be taken out by the customer to cover for the trademan not having insurance, including if it's a company that goes bust to avoid the claim.

Interesting that the article states more than once "Public Liability" insurance not "Contractors Insurance", but as i have said on here before an Insurance company can not refuse to pay out unless deception was used to take out the insurance or the claim is proved to be false, more to this than meets the eye.

Also who was the Designer and or the Health and Safety Supervisor under the CDM Regulations? lots of unanswered questions.
