that's more applicable to individual circuits rarther than the whole installation. look atr 537.2.2.1. both L and N conductors are "live".

ok im happy to go with 537.1.4, so would you code this a c3 as must of been fine when installed 19 yrs ago

Yes you can, otherwise you will be passing dangerous installations as satisfactory!

An EICR is an assessment of the safety of an installation for continued use which uses the current version of bs7671 as the standard of safety against which the installation is judged.
If an item is immediately dangerous then it is coded C1, if an item is potentially dangerous it is coded C2 both irrespective of whether it complied at the time of installation or not.
Safety improvements which could be made are recommended via the C3 code, this often relates to items which complied with previous regulations but improvements are now possible.
It is not a report on absolute compliance with the current regulations which is why it must not be used to certify new work.

Fused neutrals, bare conductors in wooden trunking, open fronted switchgear, bare busbars insulated by paint only, live parts accessible without the use of a key or tool were all permitted once upon a time, but all get coded.
