I have a double oven connection unit. Fed with 4mm cable,40 amp MCB. Hob connected to it with 4mm cable. Bought new oven,stated 16 amp but with 1.5 flex from the oven. (manufacturer) I'm trying to argue that this needs a fused spur before connecting to double oven connection unit as 40 amp MCB is too high to protect 1.5 flex under fault conditions. Instructions say connect straight to double oven connection unit. Any expert opinions please. I'm sure I've explained it correctly
 
4mm cable is undersized for a 40A supply, the minimum that should be is 6mm but may need to be bigger due to de-rating factors.

As an oven is an appliance not subject to overload the 1.5mm flex may well comply as long as it is suitably protected against fault by the MCB.
 
Basically though The 40 amp MCB would not protect a 1.5 mm flex and would require a fused spur to protect against short circuit. As you said overload should be ok. It's the 1.5 flex cable that comes with oven I'm concerned about

No, the 40A MCB may protect the 1.5 flex against short circuit, you would need to do the maths to confirm that.

I didn't say overload should be OK, I said an oven is an appliance not subject to overload faults.

A fused spur would not be suitable if the oven requires a 16A supply as a fused spur is limited to 13A
