The light already installed can be controlled from the top and the bottom of the stairs and I was advised to buy a 1 gang 2 way switch. The old light switch has 4 terminals but the new one only has 3. My question is where the earth goes as there is no terminal for it on the switch or inside the back box.

Disconnect the short earth tail from the terminal in the back box, leaving the earth wire from the incoming cable still connected.

Hi Thanks for your reply.

Do you mean I should leave the earth in the u shape where it is and remove the other earth wire that is hanging loose completely
