hello, going round in circles with this.

long story short carried out and issued EICR(over 6months ago) on a 2 bed flat less than 10 years old.

landlord who i knew for a while has turned sour and isnt paying me( kept saying will speak with accountant bla bla bla.)

anyways ive tried phoning glasgow city council etc to try to void the cert as i dont want to be held reasonable/liable incase of fire or somthings melts whatever. ive also contacted direct line pl insurance but got no where with them.

anyone know which route to take? ive thought of small claims and all that but its not worth it in this case or my time/stress to deal with this anylonger
 
Small claims. Normally the threat of this will get them to pay.
 
lol, yes got text messages getting go ahead. im not caring about getting money back. i just told want to be liable for any accidents or fire damage etc from electrical faults as it is my name signed on the cert. im on call to citizens advice the now
 
My experience from people I know unless you have a really strong case evidence wise etc it will be hard in a small claims court for much to be done you would need contract times dates etc of everything in black and white
 
A eicr is only as good as the day it’s done in my eyes basically at the time testing and inspection was carried out everything was electrically sound. For all you know a cowboy or themselves could alter the wiring etc

Don't involve the tenant. Small claims against the landlord, don't just write the money off, you're running a business not a charity.
 
Do you have all the details for the landlord like home address etc as you will need these I would imagine can’t just send these things to the tenants house to pass on?
 
Op, honestly don’t understand why you are expending energy “ trying to void” the EICR. Assuming you are happy with the content/accuracy of your report, you are no better or worse off than for any report you have issued.
Simply, the issue is you have not been paid for work you were contracted to do. Issue the appropriate reminder/warning before action letters and raise a Small Debt action if necessary.
Don’t get me wrong, late/no payers p**s me off no end, but focus you’re energy on getting paid would be my advice.

Is it even possible to void a eicr? I thought after issued that’s it kind of like a mot test certificate after been approved can you just undo it just curious

as you are in Scotland £50 paid to the a local enforcer down the local boozer usually revolves these issues.
 
But if the client just takes the eicr and fakes the signuature or whatever they then have a valid eicr? No one would know it wasn’t signed by whoever done it until something went drastically wrong or whatever so then they would more likely be like I’m not paying? Cash up front always before eic/eicr or its a no go
 
Just saying this because I’ve heard people fake eicr to sell house or whatever and they have never had comebacks done agree but shows how easily it can be done
 
I don't do a lot of EICR's because others seem happy to bash them out for £50-£70...instead of emailing an unsigned one most test software or even PDF Printers allow printing of a watermark over each page...could even have something like "SPECIMEN, FULL COPY SENT OF RECEIPT OF CLEARED FUNDS"
 
hmm, guess your right not to involve tenant. ill sleep on it and tackle this shitshow tomorrow. thanks for the help

I'm assuming the landlord instructed you to do the work ......... so you have no reason to involve the tenent.

You should begins the process of chasing after 30 days, progressively getting stronger in your actions until issueing court proceedings after 60 days.

You are in business to earn a living!
 
Small Claims is easy. It is also why I try and do everything by email.

Only had to take one customer to court. They folded on the morning of the case and paid everything owed. I still went in and was awarded expenses for a full days work!
 
Was the EICR a verbal instruction?
have you had any other correspondence other than verbal eg email of the address from them regarding the property
was there anything on the report that the agent would dislike eg C1's that they would have to spend money on
what action have you taken regarding this invoice eg sent text emails, letter and had no response back from them.
These are all points that would/not go in your faver if you go down the small claims route
 
hi again, no im not going down the small claims route its not worth it. ive done alot of work for this person past 3 years and past few jobs been very easy so not a huge loss not getting paid for this eicr. not heard from her in 3 months regarding any new work so ive kinda took the hint. unfortunately for her shes lost a very decent and fair spark who didnt pester her for money and done all jobs above board. to be honest she was an idiot and i dont know how she run a business, like sending me wrong addressees, many spelling mistakes, once kept calling me by a different name lol like gary coz he had same toolbag, i mean shes on another planet. i hope now she'll get some dodgy spark to do her work and will totally regret it, not to mention they will go after her if not get paid and all that. oh well good riddance, i wont be losing sleep over this. in the mean time im focusing on other contracts and making better money working for this idiot. once was charging her £40 call out coz just started buisness and didnt have much of a clue for price and all that.

Bit confused about you being concerned about being held liable? Surely if you completed an EICR that just details the state of the installation. Once you’ve given that to client it’s down to them to act on your report and recommendations whether they’ve paid you or not?
 
At least send her an email/letter what have you to lose than 5/10 minutes you never know she may have forgotten about you and then pay.
 
What about the next tradesman/woman that doesn't get paid and has to chase her up?
 
Not getting paid is a real pain. I never issue the certificate before I get paid may seem harsh but the dishonest few ruin trust for the majority.
 
Part of the contractual agreements that your services have been employed is that you comply with BS7671 this includes inspection and testing then issue of an appropriate electrical certificate not doing so could be taken as a reason for non-payment.
 
I have the odd non-payer and two days ago after completing £155 job in 2015 I have again left a paper invoice/certs dated with final demand and 30 days to pay all nicely worded...photographed(date stamped photos) and duct taped in envelope to front door again photographed....it will be a CCJ next month if not payed....it does not matter if it is £30 it is worth getting someones name logged with CCJ (credit sore etc) who is avoiding payment....In your case forget voiding the EICR just send email/txt and hand delivered copies x2 after that state further action will be taken on the 3rd invoice/letter...usually works. and BTW I am very behind on invoicing anyway. No one should mess with your wages if you have done an honest job.

When you take court action against a non payer , your extra costs are added to their bill.

And never get behind with your billing. .....
