Is it safe to use a 40 amp cord with a 50 amp outlet?

Bought a range from Home Depot. They supplied a 40 amp cord. Electrician was going to use a 50 amp outlet.

Being from the UK, I'm not 100% sure of the local codes. If it's anything like here however, I would think as long as the OCPD is rated for the lowest cable rating it should be ok.
