6mm T&E on 40 amp mcb

while doing EICRs i often find this combination, if its clipped direct it dont worry me
however many times i have no idea how the cable is routed
im just wondering how others would code this?

I wouldn’t code it unless evidence of thermal damage, that’s if it wasn’t obvious that it was installed in a reference method lower than the Ib or Iz of the circuit

agreed, if the load is 34A for a fixed appliance the no problem. you can do the calcs. and see if the circuit is good for continued use.

Don't forget that there is a part of the certificate that is a disclaimer for cable concealed in the fabric of the building.

they usually feed a 8 or 8.5KW shower which is fine as long as the cable dont go though some hidden insulation for too far

Does it matter what load is attached? If there was no load whatsoever, so let's say a 6mm t+e directly into a spur but no load, protected by a 40a mcb but going through insulation. Would you code it?

Yes it does matter, if there is a fixed load not subject to overload faults then the cable may not require overload protection, so can be sized according to the load current rather than ocpd rating.

Assuming by spur you mean a fused spur then there is technically no problem because the load will be limited to 13A, though I may suggest that a lower rated mcb would be more appropriate.
