Water heater stat without over heat trip

If doing an EICR and you find an immersion heater stat with no over heat trip do you code it? Another spark I know makes it a code 2 - unsatisfactory. Thoughts please

If it has a plastic water tank then i code it a 2 , if not a c3

been a very recent thread on this a day or so explaining why

I agree a over heat stat is a good thing, but strictly speaking isn't a water heater a appliance and therefore not part of the wiring EICR testing ?
