Why are you guys worried about whether another sparks would get a belt from it? From the point of view of the final user and not another sparks, The question is this, is it an immediate danger? No
is it a potential danger? No
Does it comply with regs? No

You are reporting on the installations condition and whether the installation is safe for continued service in the fashion to which it was installed for. Neutrals and earths in the wrong terminal numbers does not make this unsafe.
