The question now will be - how many people will fire up their lawyers to get compensation for any losses?
 
fast work guys, lol, beat me by about 5mins! Good news I guess....will this simplify the process of explaining the situation to the end-user, or make it more complex?
 
Does this mean that DECC will push for the lowest of the 3 proposed digression schemes??
 
Andy is right.
The real issue now is what this means for the industry going forward in terms of the FITs budget and the Levy Control Framework. We may know at the beginning of April whether or not the Office for National Statistics considers FITs inside the public spending envelope. If it is not there may be some leeway but do not depend on it.

We got a further rodgering in the budget over capital allowances so do not count on friends in high places. There may yet be a spiteful response from people who govern by cock up.

Just emailed all our February customers to let them know it's party time :-) Fingers crossed they'll feel so good they'll tell their friends and family to come to us!

Great to be feeling positive for a change!

Just noticed this thread. Great news for the end of the week and good on the supreme court.

The DECC got what they deserved because of the way they handled it. Alas, they largely succeded by putting doubt in peoples mind as to what tarriff they might receive.

At least it draws a line under it now and saves a couple of years of uncertainty.
 
Well I'm a happy customer who got installed at the end of Feb. The calculations were looking OK at 21p but even better now :) ;)

This is good news for the industry. however if the flood gates open for claims of loss of earnings it'll be the tax payer that foots the bill...

I presume they have finally drawn a line underneath it as there is nowhere else to go in terms of wasting time and money. I'd love to know how much this debacle has cost...
 
I am really happy with the result as are all my customers, however the loss of earnings bit does confuse me, the only thing that would make this feasible is the lack of stock available at the time, in November / December we all saw our order books fill to capacity and we all were able to fit whate would be 4 months worth of usual installs into 6 weeks.

Loss of earnings due to the new tarrif I can understand (post march 3rd), I can understand the loss of earnings to those that could not get stock and had to close their doors, not only did they loose earnings they lost their business.

I cannot understand loss of earning where people had the advantage of installing more than they thought possible in a short period of time, not once, not twice but now 3 times. The fact that production from fixings companies and other manufacturers ramped up pre 03/03 and now pre 31/03 means that installs are more controlled and any business you lost post 03/31 you probably got now.

Economics is a fragile thing, I would assume most have had a greater turnover between October and Now compared to the whol prior year, possibly with bigger profits.
 
What about people who were planning large projects which where side railed because of the knee jerk reactionary fools ..????..how much income has been lost, never mind the instalers...I am glad to see the outcome of today...it goes to show money cant buy greg love..

But at the same time are we going to be able to sue for loss of earnings on our pension funds also, I feel sorry for those that did not install their projects in time because of the kneejerk reaction but it is only because it is within an industry that you are involved in you have noticed it.

I also lost a 50kw job but I replaced it with 5 or 6 domestic 4kw jobs so it was ok at the time.

For what it's worth, I've had a reply from DECC:

The Department estimates that its total costs in respect of its own legal fees up to and
including its application for an appeal to the Supreme Court are approximately £83,870.

The court has not yet assessed the amount that DECC is liable to pay in respect of the costs
of the other parties to the litigation.

Actually less than I thought it might be (and it came through a day before the deadline. Most unlike DECC)
 
"Its own legal fees" will mean something quite specific like the cost of the external barristers instructed for the case. It will not include the time of DECC's internal legal staff or other admin wallahs who spent many happy weeks working on the case.
 
Yes, I thought that was the case, I guess my request for the total cost of the process allowed them to be this vague!
 
The answer you got was the same that Barker gave in a written answer in the House of Commons last week.

DECC paid circa £783k to Linklaters LLP in Jan 2012. How much of this, if any at all, was for the FiTs case isn't disclosed. Linklaters do a lot of legal work for DECC. I would guess their senior people would be charging at least £1k an hour.
