I have the answer, but for info if anyone is interested:

The housebuilder will have to get an EPC to give to the person who purchases the house.

A new build EPC is not just for the person who buys the house. It is also required to show that the property complies with part L of the building regulations. No EPC on anything generally built after April 2008 means the building can't be properly signed off for building regs. Although a few have slipped through the net.
