So someone is appointed to decide cases like this on the back of his/her legal background then sits on the fence claiming to be too inexperienced to do the job.
Write to The Lord Chancellor's Office to complain mate, that is bloody ridiculous

Im glad its not just me who thinks so. I just can't believe it. It didnt outline the fact she felt she wasn't experienced enough in this field in the letter, she openly admitted that during the hearing, so i assuming that is still the reason why it is being handed down.

The judge hadn't read of the court notes, hadn't read either of our statements or information packages, the whole thing on the day was done from the ground up without her having any prior knowledge, which frankly i felt was pretty poor, considering the amount of money i have paid and time i have wasted building this case up, i expected the judge on the day to be as intimate with my case as they are with their own genitalia. Instead it was just a trade off from one side of the table to the other (of which the bloke could barely string a sentence together anyway).

Felt pretty let down by the whole system from start to finish to be honest. It is a simply case, with a simple decision to be made.

Thanks for all your posts lads,

In regards to the floor boards Geordie, i totally agree, it was lazy on my behalf no question about it - bad practice without a doubt. I just dont feel it merits a financial penalty against the work i did for him. Had they had an issue with the H&S aspect of it, that would have been a different story. The scrounger was just trying to dig up excuses to not pay.

And Darkwood, this builder was certainly no mate of mine, on face value, whilst working together in the same house, he was friendly as they come, had nothing nice to say about the clients either, but when things turned sour, he got right back in their pocket, even gave a witness statement against me! So he hardly qualifies as a pal of mine.

Anyway, got my letter back from the court, the judge who heard our case feels she is inexperienced enough in this field to make a fair judgement,m so it has been handed down. Im furious. This case is so black and white i would have put my faith in a deaf monkey, i did a job, client did not pay, excuses are comical. End of.

It looks to me that you're learning - or have learned - a hard lesson bonny lad, but one which will stand you in good stead in the future. Every cloud etc............. :)

No this job has taught me than the money ever could have. Lesson number 1 - people, as a rule of thumb, are inherently bad people and will screw you given any chance possible. 2: Cover ar$e, wherever, whenever possible, just in case. 3: Bring your own coffee, other people never make it as good (if at all).

I really appreciate everyone's support on this one, wouldnt it be great if you could drag a few like minded souls into court with you in cases like this. Bit of moral support and all that. I would have loved to see the look on that beardy scrounger's face with 25 of us all sat there giving him the eye ball.

Well i believe it just means it is being referred onto another judge as the one who heard the case on the day didn't want to make judgement.

Unbelieveable!

Was she just the "the hospital gave me ten times the wrong dose of drugs and amputated the wrong leg" judge!!

Well, all that was educational!

It's crazy to read what lengths some people go to for the sake of trying to rip somebody else off. You'd have thought they'd give up at the mention of court let alone turn up and try it on in there too.

They must convince themselves they're right or something.

At least you'll get another chance to make your case, and now you've heard what the customer said at least you can make your "pitch" from a position of strength.
