Anyway, I sub contract to a company doing council properties. Long story short neighbour of property I was working in asked if I could do a fuse board change as she was privately owned. I said yes and stated it would be through my company and not who I work for. She agree and the board was changed on a Saturday, anyway she now has called the company I work for and complained about me, my bids pulls me in the office and says that I should have asked for permission to do a job in my own time with my own bits and now he said he is going to invoice me for the time that one of colleagues took to test my work and check it wasnt his gear I used. What do you think about this, he has hinted that it will be several hundreds?!?

As your a subbie they have no control over your work which isn't their own, next door or not! How much work do you get off them that what really matters?

But I can't figure out what it's got to do with him, I'm not employed, my gear my time.

You can't have your cake and eat it as they say, some employers would call it poaching work from them, as was said in post 4 got you by your short and curlies, time to move on I think

Yeah, he had never said that it was a no no, of he had would never have done it, as never like to rock the boat, but yes am now looking for something else, just don't like being called a liar and being accused of theiving

You know what some employers are like, on the books or subbing to them, you are just a number, another pair of hands earning them money and if they think you're taking money out of their pockets they'll soon replace you and use any excuse they can find.

Ok I take it you have your own business fine and you do work for company A fine So when the woman next door approached you , you made it clear that you would do the work under your own business yes well if thats the case a lawyer would say you and the lady made a contract between each other .

So what made her complain to the business you do work for ie what was the reason . Also be aware that if you do work for this company under the banner of sub contract yet they are your principle payer the HMRC may see this as a tax dodge as you are not allowed to be a sole trader with one source of income as you must show at least 3 different sources of income and it cannot be a 90% 5% 5% split because if it is then HMRC will see this as tax evasion.

Looks to me that this company is treating you like an employee so please tell me they are not your only or main source of income

if you didn't use company van or company materials and it was your time you did the work in then the mistake is yours and YOUR!!!! company is to blame. this company you work for shouldn't be involed you did there work and plus you say she privatly rents so the council have nothing to do with that property.

i think its time for you to go solo and ditch these busy bodies they dont sound to friendly.

It's on you don't have to tell me a out hmrc ( my wife is an accountant), I am Ltd so not a sole trader, but yes they do treat all the subbies as carded, eg uniform and make us put mag signs on our vans etc

So why did she complain about you, was it your workmanship or something else like the cost the mess or .................???

Tell your wife this is still tax evasion only thing is you are hiding behind a Ltd company that will not wash if you are audited 25 year ago this was a big thing but HMRC started to crack down on the big companies for this mostly petrochem and Banks who were using it to pay themselves dividends and not a wage so saving themselves Income & NI tax.

So it still comes down to source of income looks to me that the company you sub to is doing this to evade employers NI contributions pensions etc . Ask your wife to check this out as all it would take is a guy who is hacked off with this firm to then report them to HMRC who would use it as a big stick to other companies who are doing the same.

This is why I asked because to me it read that they were treating you as an employee and if they check your work out then they are doing just that O Dear

Funny enough I went through building control so as not to have anything to do with the company, and the cert I have her she said was Mickey Mouse, hence the call to my office

Exactly that, treated like an employee but without the benefits
