Hi all, Just a quick question about Perioidic Test and Inspection on a rental property.

I know the regs say that it should have a Periodic Test and Inspection every 10 years or change of occupancy.

Is this just a recommendation?

Its for my sister. I am unable to sign work off as I am an electrical shift engineer but familiar with test and inspect.

Is it acceptable for the property to be certificated every ten years, then I test it myself on change of occupancy and keep record of the results.

What would happen if for some reason the tenant tried suing for an electrical fault?

If you're competent to carry out an EICR then crack on mate, if it's meeting the recommendations what is the problem.
As far as a tenant suing, if he had a valid point he would win his case. If not he wouldn't.
If your sister had kept up with recommendations and maintenance and fixed any faults as the tenant reported them then the situation will never arise. If the tenant does not report a fault and then tries to sue over it then he would get laughed out of court.
 
Under the Landlords and Tenants Act, the Landlord has legal obligation to supply and maintain a safe and serviceable electrical installation. The RECOMMENDATION is for inspect/test at 5 years or change of tenancy, it is only a recommendation and not a legal requirement of the landlord and tenant act, but compliance with the recommendation will make sure it complies.

Like anything else, it is all down to common sense and judgement, and will only come into question when something goes bad, and paperwork is asked for.
