This is my first post, So i must say hello to all the members! :)

Right i have a few questions,

This is my first flat i have rented so i am un sure of the rules ect...

My oven trips out when it gets hot,

Its very old oven its a delonghi eoc360-1g

It bypasses the pole switch (oven switch)
And plugs straight into a 13amp socket, Which also has a dishwasher and fridge plugged in,


BUT my biggest concern is that when i turn the RCD to off which turns THE WHOLE flat off, I still have a live cable running through the flat, A sparky has tested with a toner type thing.

Can someone please advise asap, Does it sound unsafe?


Bit more info the flat i live in is an old house which has been converted into 3 flats and a shop.

sounds like the live cable is part of the shop installation or maybe another flat. where is this cable? is it under your floor? a bit more info. would be required.
 
Sounds like your man has tested with a volt stick and found a feed to another flat or one of the circuits in it. The oven tripping is probably a fault in the element becoming apparent when it reaches full temperature.

Didn't the sparks who tested it with his 'toner type thing' advise you on wether or not it was safe???
 
The cable is in a cupboard where my fuse box + rcd are located,

The element in the oven was changed earlier this year, It is a very old cooker and i can not seem to find any support for the model, My landlord claims it was 1 year old when i moved in may 2011. Which i am sure is a lie,

If the live cable is running to the shop, Or to another flat where do i stand? Should this be in my property?
 
Is the "Live " cable visible or buried in the wall?

As above it's most likely the supply to another flat.
Non contact testers can sometimes pick up a wet fish at 50mtrs, not always a reliable indication, but do have thier uses.

If the cable is visible it's origin / destination should be traceable.

What is the oven tripping, the RCD ?

He is my brother in law, he is qualified sparky, he said everything is a BIG NO NO, Each breaker in my fuse box has 2 cables coming out also,

He explained that its all old wiring (Red/Black) , also the cooker was poorly earthed when he took the socket off the wall the earth was hanging... He has reconnected for me but still have issues.

The cable that stays live seems to go up to the flat above me, It just comes straight out of the floor to the top of the ceiling and disappears,

The oven TRIPS my WHOLE flat the RCD (Main Switch) trips to off, NONE of the breakers trip,
 
nothing wrong with red/black wiring. it was only discontinued in 2006 when control of the country passed to the hitlers in brussels.
 
Forgive me for this but if your brother in law says it's a no no why do you need a second opinion? One of my brothers in law works in insurance, if I have a pension related problem I'll ask him and accept his advice. I'm not having a go or anything I'm just wondering if you question his skill level or something

Well he was in a rush and don't live near me so i couldn't have him for long, I just need some legal advice to be honest, I am not questioning his skills, but its always best to get more then one opinion,
 
The wiring in the flat is the landlords responsibility.
If the oven is included in the rent then so is that.

Your Brother in Law is in his 20's?
 
My landlord has advised me to clean the oven, And he has not been able to show certificate of electrical safety test, He just changes the subject, From experience what would you do?

I believe you don't have the right to demand to see the electrical or gas certs but if you have serious doubts a good port of call for you is your local Environmental Health Department they have powers that most people don't realise and would be better placed to give you advice from a legal standpoint, we're sparkies not lawyers.
Please let us know how it pans out though, I think at 6 posts you can show us photos which might help us to give you electrical advice though so give it a go.
 
There is nothing wrong with two cables in a breaker aslong as the cables are correctly sized and the breaker not overloaded.
I don't see a issue with the cable running up through the cupboard.
As for the oven does sound like the element.... When it was replaced recently isn't really a factor. Especially if it was a cheap copy when it was replaced lol!!
If the oven was there then it should be up to the landlord to sort it.

How was this tested to say it was live? If with a volt stick then needs checked with something a bit more suitable, it doesn't take much for them to light up.

Oven, Fridge, Dishwasher all off a 13Amp Socket? That sounds a pretty dire setup, is it through an adaptor type plug, or are each in a separate socket?
