So in short if it's in zone 1 the only restriction is it has to be IPX4 or protected against objects greater than 1mm. The socket holes are clearly bigger than 1mm so it's a no no. I imagine the chain in question had a refurb and the bath was moved. I don't suppose the builder or plumber knew they'd be introducing a non compliance to BS7671 2008 (2011) I'd be very surprised if it was designed this way from the outset
