Morning all I've turned up to a job this morning for a bathroom fitter and he's supplying the materials. There's an attic above with insulation and has supplied none fire rated spots. It is a existing I installation and all circuits already rcd protected. Can I legally use these non rated spots? I wouldn't usually but he's into me to save money
 
The short answer is yes you can, but you need to leave a gap in the insulation around them. Read the manufacturers instructions as well to see which bathroom zones they are suitable for, as depending on the height of the ceiling you may not be able to use them above the bath/shower. Remember, the IP rating of anything you fit must be suitable for the location.
 
I believe that fire rated are only required if a habitable area is above.

Bet there as cheap as chips, as fire rated aren't that much more expensive.
 
As already said, the spot doesn't need to be fire-rated, but it does need to be suitable for the environment. I'm sure that you know the regs for bathrooms so I'm not going to quote them.
I would also make sure that manufacturers instructions are followed regarding the air gap around the fitting and provide a suitable hood.
