unearthed conduit query

Came across a 5 metre length of unearthed inch and a half metal conduit riser with three phase, neutral and earth conductors inside. The conductors are all double insulated tails and I just wondered if it really should be earthed as it runs through a bathroom and can be touched (it'll be very awkward to earth as it is not easily assessible)

Just googled iet forum and remember myself now was outlawed to put metal conduit in bathrooms in 16th edition REG 601.07.01 page 123 but apparently it is now ok but cant verify this
